These are the Terms & Conditions of Sale applicable to on-line purchases from Offroader Australia (www.offroadshop.com.au). These conditions should also be read in conjunction with Offroader Australia General Website Terms and Conditions of use.

These terms and the laws of Victoria Australia, apply to all transactions for the purchase of products ("Products") from Offroader Australia through its web site at www.Offroader.com.au and any associated web page (the "Site"). These terms represent the complete Agreement between Offroader Australia and the Buyer covering the sale of Products from this Site. Except for terms implied by applicable legislation, Offroader Australia does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Buyer's completion of the Order form on this Site will constitute an offer to the Buyer to purchase Products (the "Order"). All Orders are subject to acceptance by Offroader Australia.

PRICES

The prices to be paid by the Buyer for all Products will be Offroader Australia's current selling price on the date of receipt by Offroader Australia of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as set out on the Checkout.

Offroader Australia will not be responsible for errors in pricing that appear on the Site. Offroader Australia will notify a Buyer in the event of a pricing error on the Site before an Order is delivered. The Buyer will have the opportunity to cancel their Order within a reasonable time.

Offroader Australia reserves the right to change its prices from time to time without prior notice to the Buyer. All prices in this website include Australian Goods and Services Tax (GST) at 10% this is recalculated at the checkout and shown in the price breakdown.

The GST payable by the Buyer will be shown on the invoice, which Offroader Australia will send to the Buyer. Delivery charges to the nominated address will be advised to the Buyer on the Checkout and Order confirmation pages of the Site.

STOCK AVAILABILITY

If a standard order Product is "Unavailable to Ship" within 3 business days after Offroader Australia processes an Order, Offroader Australia will contact the Buyer to discuss delivery times or refund options. On custom and special order products, Offroader Australia will contact the Buyer should the expected delivery time exceed the time allotted for shipment of that product.

ORDER DELIVERY AND CANCELLATION

All Orders by the Buyer under this Agreement must be placed via the forms provided on this Site and must specify the information requested, including (but without limitation):

(a) Quantity and description of Products
(b) The full street address to which the Product is to be delivered
(c) Current billing address to which credit card statements are sent should a credit card be used for payment. (d) We do not deliver to Po Boxes

The Buyer must complete all information requested on the Order form before the Order is processed by Offroader Australia.

Offroader Australia will not accept orders:

(a) If the Buyer does not offer to pay by one of the payment methods listed in this website; or
(b) If the Buyer's credit card provider does not confirm the payment.

Offroader Australia will send the Buyer an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Offroader Australia does not accept the Buyer's Order for any reason, it will inform the Buyer by email in the same manner.

DELIVERY

Shipment of a standard order Product will occur between 1-6 business days after acceptance of an Order. A Buyer cannot arrange collection of Orders from Offroader Australia either in-person or via alternative courier.

The Buyer acknowledges that Offroader Australia may, from time to time, be subject to production, delivery or other unforeseen delays and that Offroader Australia may allocate distribution of Products ordered among its customers at its sole discretion.

If Buyer's Order has not been delivered within a reasonable time, the Buyer should contact Offroader Australia at: info@Offroader.com.au.

If no one is available at the delivery address to receive the Products, Offroader Australia's delivery agent will leave an "unable to deliver" card at the address and the Buyer should follow the directions on that card to obtain delivery of the Products. Offroader Australia reserves the right to make partial delivery of an Order.

PAYMENT

Payment for Products purchased from Offroader Australia via the Site can be made by VISA, MasterCard, or Bankcard credit cards. We also accept Paypal, Direct Bank Deposit.

Offroader Australia will verify the credit card information submitted by the Buyer and will advise the Buyer that the Order has been accepted. The Buyer agrees to submit to Offroader Australia such information as may be reasonably requested by Offroader Australia for the authorisation and verification of its credit card purchases.

Offroader Australia reserves the right to exercise its lawful remedies if a dispute arises over payment through the Buyer's credit card provider. In particular, but without limitation, if the Buyer's credit card provider rejects a payment when due, Offroader Australia at its discretion may delay or cancel delivery of Orders placed by the Buyer.

Offroader Australia may also offset and deduct from any refund due to the Buyer all sums owed by the Buyer to Offroader Australia. If the Buyer's account is placed in collection, Offroader Australia will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.

CANCELLING AN ORDER

If the Buyer wishes to cancel an Order prior to shipment, the Buyer must contact Offroader Australia Customer Service immediately on 0424 503 875 and or e-mail info@Offroader.com.au. Offroader Australia will endeavour to accommodate the Buyer's request, if the merchandise has not shipped.

If the Buyer's entire order is cancelled prior to shipment Offroader Australia will apply a credit to the Buyer's credit card and may also apply a cancellation fee.

If an Order has already shipped Offroader Australia's normal returns and exchanges procedure will apply.

DEFECTIVE ITEMS AND WARRANTIES

All parts are covered only by manufacturer’s warranties and/or guarantees.

If an item arrives in not new condition as a result of a manufacturer defect, or a defect occurs during the intended use of the product, please contact us on 0424 503 875 for further information.

Offroader Australia does not reimburse for labour, incidental, or any other costs related to the installation of products under any circumstance.

FREIGHT METHODS

Offroader Australia will arrange delivery of all Products to the Customer using its nominated freight carriers. A Buyer must not arrange its own courier to collect the Products from Offroader Australia.

INCORRECT SUPPLY OF ORDER

If due to a warehouse or other error on the part of Offroader Australia, the Buyer receives a Product which does not conform to its Order, the Buyer must contact Offroader Australia within 7 days of receipt of the Product and may purchase a replacement Product from the Site, after returning the original Product to Offroader Australia, provided that the returned Product is in new condition with its original packaging unopened.

DAMAGED SHIPMENTS

All packages should be completely inspected at the time of delivery. Damaged packages should be refused. Please then call the freight company or Australia Post (whoever is responsible for the package) and report the damage. After contacting the carrier, please call Offroader Australia on 0424 503 875 for further assistance with the damaged shipment, and to make arrangements for a replacement.

INTERNATIONAL ORDERS

Offroader Australia accepts international orders from anywhere in the world.

International orders may be placed via our online shopping cart.

Shipping Rates

All international orders are subject to additional shipping fees, and are not eligible for free shipping offers. To find out the shipping costs, please email us with the exact items you wish to order, and the address to which they will be shipped.

For international orders placed online, a representative of Offroader Australia will contact you with 1-2 working days to confirm your total price and shipping rates

Returns & Replacements

Under no circumstances can credit be considered unless original INVOIVE NUMBER accompanies the goods for

• undamaged goods returned in 14 days from date of invoice full credit will be allowed
• undamaged goods returned in 15 – 30 days from date of invoice a 10% Restocking Fee will apply
• undamaged goods returned after 30 days of invoice will only be considered upon consultation with Offroader Australia's representatives.
• NO CREDIT will be allowed a credit will not be allowed on any item having an invoice value of less than $5.00 list no credit allowed on electrical goods
• Warranty: Manufactures warranty applies if you require clarification on this please contact Offroader Australia info@offroadshop.com.au
• All returns are at the cost of the purchaser
• All items must be returned in there original package any damage to packaging may result in additional fees being applied.
